SB3 - Motor vehicles, golf carts and low-speed vehicles, prohibited from use on public highways

Synopsis and Analysis: Under existing law, a golf cart may not be operated upon the public highways of the state unless the manufacturer of the golf cart certifies that a particular golf cart is designed for use on the streets and highways of the state and the golf cart meets several statutory requirements, including having a license plate tag, being equipped with safety belts, rearview mirrors, horns, and head and tail lamps.

Also under existing law, municipalities in Baldwin County and Class 2 municipalities, by ordinance, may authorize the use of golf carts or other low-speed vehicles.

This bill would provide that, except as authorized in Class 2 municipalities and Baldwin County, and except as may be authorized by local law or municipal ordinance under certain conditions, a person is prohibited from operating a low-speed vehicle on the public highways of the state.

This bill would establish a fine for a violation.

Amendment 621 of the Constitution of Alabama of 1901, now appearing as Section 111.05 of the Official Recompilation of the Constitution of Alabama of 1901, as amended, prohibits a general law whose purpose or effect would be to require a new or increased expenditure of local funds from becoming effective with regard to a local governmental entity without enactment by a 2/3 vote unless: it comes within one of a number of specified exceptions; it is approved by the affected entity; or the Legislature appropriates funds, or provides a local source of revenue, to the entity for the purpose.

The purpose or effect of this bill would be to require a new or increased expenditure of local funds within the meaning of the amendment. However, the bill does not require approval of a local governmental entity or enactment by a 2/3 vote to become effective because it comes within one of the specified exceptions contained in the amendment.
