Summary/Synopsis: Constitutional Amendment. Motor vehicles, taxes and fees, portion authorized for use for public transportation, Amendment 93, as amended by Amendment 354, (Section 111.06, Recompiled Constitution of Alabama of 1901, as amended). The amount that would be authorized is a minimum of 10%.
LWVAL Action and Justification: LWVAL supports HB207. The League’s position on Public Transportation specifically states support for: “Revision of Constitutional Amendment 93 of 1952, as amended by Amendment 354 of 1976, to include public transportation in the permitted uses of gasoline taxes.”

SB79 - Counties, gasoline and motor fuel excise tax, county commission authorized to levy up to five cents after referendum, based on list of road and bridge projects, collection by county or Revenue Department, additional levies authorized

Summary/Synopsis: This bill would allow a county commission to call for a local referendum to authorize the commission to levy an excise tax on gasoline or motor fuel not to exceed five cents ($.05) per gallon for specific road and bridge projects identified by the county prior to the referendum. The resolution calling for a referendum would specify the amount of the levy and the duration of the levy which could not exceed five years. Subsequent local referendums on additional levies would be authorized under the same procedures as the original referendum.
LWVAL Action and Justification: LWVAL is monitoring SB79. This legislation is intended to add a revenue stream for much needed local road maintenance and construction and gives local citizens an opportunity to vote on the tax increase. The League supports such action. However, the authority is time limited and another example of Legislative control over local government finances which the League does not support.
